09/043 Minutes

Resolved by unanimous agreement that the minutes of the meeting held on 9th March 2009 be signed by the Chair as a true record

09/044 News from EDC / CCC / Cumbria Police

No representatives from EDC or CCC attended the meeting. Andy Holliday from Cumbria Police raised the following concerns:

i.)                  Suspicious vehicles have been spotted parking up near hen-harrier nests. These reports have been checked out and no malicious activity has been identified.

ii.)                 Travellers were recently parked up at Threlkeld Cricket Club and were moved on but were last seen at Eamont Bridge.

iii.)               An incident occurred today (Monday 11th May) in Penrith whereby an elderly gentleman was approached about the possibility of needing any gardening work doing. Whilst the man was kept talking someone entered his house and stole various items. The public are advised to be aware of the possible increase in such incidents relating to various work proposals such as gardening, guttering and tarmac-ing in light of the forthcoming Appleby Horse Fair and the increased numbers of travellers in the area.

iv.)               There have been several recent reports of machinery being stolen from farm workshops

v.)                The police will be showing an increased presence in Swineside during the summer to minimise illegal camping in this area of special scientific interest.

09/045 Public Participation

The Chairman adjourned the meeting to allow electors present an opportunity to raise issues of concern or interest. The following matters were raised:

i.)                  The council was informed of the Berrier Wind Farm public inquiry which will run for eight days in two stages, 8th to 12th September and 15th to 19th September. The council was asked to attend the inquiry in an official capacity and voice its opposition to the wind farm.

ii.)                 The council was told that the residents of Hutton Roof would really appreciate its support in the issue of illegal encroachment of highways waste at the Hutton Roof pub (see item 09/055).

iii.)               The council was asked to make clear the rules of public participation.

iv.)               The council was urged to pursue the issue of re-routing the X4 / X5 bus service (see item 09/052).

Financial Update

An update was given on the financial position of the parish council and the council bank balance – including the reported transactions - currently stands at £5847.89.

Internal Auditor

Approval was sought from the council to appoint Anne Simpson as its internal auditor for the financial year 2009/2010. Unanimously agreed. 

09/048 Planning Applications Received

·        7/2008/3105 – Mr D Scott, Stewart Hill Cottage, Hesket Newmarket – Extension to provide sun room. No objections were raised.

09/049 Planning Applications Decisions

·        7/2009/3006 – Mr A Bird, Askew Rigg, Troutbeck – extension of an agricultural building, erection of feed bin, relocation of existing feed bin. Letter of support sent to LDNPA on behalf of the council. Granted with 2 conditions.

·        7/2009/3015 – Mr R Clark, Stone Ends, Hesket Newmarket, Wigton – extension of additional bay to open-fronted G P storage building. Granted with 4 conditions.

09/050 Eycott Farm Update

The appeal hearing for the non-removal of the static caravan at Eycott Farm, Berrier will be held in the Council Offices at Mansion House, Penrith on Wednesday 8th July. The council has prepared a letter to be read out at the hearing. Unanimously agreed by the council that two members would attend the hearing and reiterate its objection to the siting of the caravan.

09/051a Berrier Wind Farm Update

Following the request during public participation from the Berrier Wind Farm Opposition Group the council unanimously agreed that it should be represented at the public inquiry on the appropriate date in September.

09/051b Parish Land Registration Update

Two councillors recently attended a seminar held by the Land registry and discovered that it is fairly common for parish councils not to have the title deeds to land in their parishes. Photographs have been taken of the enclosure award for Mungrisdale (held at the records office in Carlisle). These need to be pieced together then sent back to the archivist for authentication. This is the only proof of parish land available. Village greens are currently only registered with the Commons Registry and also need to registered – as village greens – with the Land Registry. The exercise will cost about £30. The Land Registry is keen to assist in a any way it can.

09/052 Mungrisdale Road End Bus Stop Update

The clerk read out a letter from the Stagecoach bus company which was sent in response to the council’s request to re-route the X4 / X5 service at Mungrisdale Road End via the old A66 to alleviate passengers having to cross the busy road. The letter listed a series of safety issues the company felt ruled out any possibility of meeting this request. Following further discussion the council decided the matter should not be pursued any further.

09/053 Highways Update

There was nothing to report from the Highways Steward.

09/054 Hutton Roof

Approval was sought from councillors to permit the Lake District National Park Authority (LDNPA) to raise the path across the village green and make it hardcore to alleviate the flooding problems it currently has. The LDNPA is confident it can meet the required funding. Unanimously agreed on the basis no council funding is required.

09/055 Hutton Roof Highways Waste

A letter was read out from Cumbria County Council (CCC) outlining its position on the encroachment of the highways waste around the pub at Hutton Roof, and requesting the council’s opinion on the encroachment before any further action is taken. Hutton Roof residents are concerned that any stopping up of this part of the highway would set an unwelcome precedent and strongly oppose it. Unanimously agreed the council will write to CCC to declare its opposition to any such proposal.

09/056 Lake District Parishes Meeting 27th April

A brief summary of the Lake District Parishes meeting was read out. A hardcopy is available from the clerk.

09/057 Cumbria In Bloom

The parish will not be participating in this year’s scheme due to lack of interest.
