Minutes of Meeting held on

    Monday 4 July 2005 at 7-30pm

Chairman welcomed councillors, members of the public, and PC Andy Holiday to the meeting

Present were Lesley Smith, Alan Tiffin, Dorothy Chalk, Ernest Bird, Ernie Teasdale and 12 Parishioners

1.      Apologies received from Michael Bohling, Les Wilson, Ronnie Wilson and Roy Fisher (Eden District Council)

2.      Minutes of the meetings held on 9th May 2005 ~ Annual Meeting of the Parish Council; Parish Council Meeting and Annual Parish Meeting were agreed and signed by the Chairman

3.      Andy Holliday ~ Community Police Officer introduced himself and gave a short talk on his role

4.      Public Participation

The chairman adjourned the meeting to allow members of the public an opportunity to ask questions or raise matters of interest.  The following points were raised/ discussed:

·         Vehicles are being parked on the track at Hutton Roof in front of the gate to the field at the right of Hutton Roof Farm and this is blocking the footpath.  It is not known who owns this small area.

·         Concern over access to the green at Hutton Roof  if a cow and calf are grazing and who is liable if there is an accident

·         Drains are blocked from the main pond on Hutton Roof Green and this was identified by Wilson’s Plant contractor when the track was resurfaced recently.

5.      Declaration of Interest

·         Alan Tiffin declared an interest in point 25 ~ Foxhunting

6.      Accounts 2005~2006

·      payment of the following Bills due was authorised:

§         Local Council ~  Renew subscription £13

§         Althams £26-64 1 bag of post fix for new notice boards

§         United Utilities – water bills £6-16  and £9-55

§         Payment to the Herald for the Hutton Roof Notice £93-60

·       Income from Car Parking in June and July totalled £185-69

7.      Requests for Funds for the following organisations were declined

·         Cumbria Playing Fields Association – Affiliation Fees £13-30

·         ChildLine ~ any financial support possible or to organise a fund raising tea

8.      Planning Applications ~ Received

·         7/2005/3089 Home Farm Bowscale ~ vary condition 7 of approval 7/2003/3081

9.      Planning Applications ~ Decisions

·         7/2005/3040 and 3041 The School Mungrisdale ~ Approved with 4 conditions

·         7/2005/3043 Chapelside Mungrisdale ~ approved with 7 conditions

·         7/2004/3076  Mr C Hockley, Blakebeck ~ Approved with 5 conditions

10.  Hutton Roof ~

·         An application has been submitted to Defra in respect of the fencing

·         Request to graze a cow has been received from Mr Barnes at Hutton Roof Farm and the council decided to decline this request.  Letter to be sent to Mr Barnes,

11.  LDNP – Demonstrating Housing Need Workshops – dates were advised and the clerk is hoping to attend on behalf of the council

12.  Citizen Engagement document from Office of Deputy Prime Minister ~ update was given by  Councillor Chalk and the suggestion is that a Neighbourhoods Charter is produced and responsibility moves to local councils

13.  Outer Lakes Area Action Plan – Consultation Draft on transport issues, problems and opportunities. Comments by 26 August to be dealt with by the Clerk

14.  British Telecom Consultation – removal of Cash facility for Hutton Roof and Berrier phones was accepted by the council but it was hoped that the phone boxes would remain

15.  Countryside Agency ~ Access map has been issued

16.  Rights of Way Improvement Planning in Cumbria ~ questionnaire to be returned by 15 July

17.  Penrith Market Town Initiative is awaiting funds

18.  CALC ~ General Meeting 22 June 2005 at Newton Rigg was attended by Councillor Chalk and the Clerk.  The constitution for CALC was agreed and the Executive Committed selected. 

19.  Planning and Compulsory Purchase Act Cumbria Minerals and Waste framework consultation statement

20.  Clean Neighbourhoods and Environment Act 2005 - timetable for implementation of fixed penalty payments for litter, Graffiti fly posting and dog offences.

21.  Quality Parish update from CALC ~ Quality status has been achieved by Keswick Town Council

22.  Invitation from Roy Fisher to service of Remembrance and thanksgiving ~ Greystoke Church 10 July at 3-30

23.  Eden District Council Scrutiny Review into Youth Services ~ Final Report received

24.  Environment Agency~ Derwent West Cumbria and Duddon Abstraction Management

25.  Foxhunting ~ Council agreed to write to the Minister for Rural Affairs regarding the potential  impact on the Parish of the ban on Foxhunting

26.  Northern Fells report ~ Routes to Independence for young people in the Northern Fells has been received

27.  Lake District National Park ~ Development Control ~proposed customer charter ~ consultation document responses by 25 July ~ Clerk to comment

28.  LDNP Consultation on Planning Applications – input from Parish Councils to be more specific

29.  Lake District National Park ~ Local Development Framework ~ Draft Statement of Community Involvement in the new process

30.  Eden District Council ~ Statement of Community Involvement as part of Local Development Framework  for planning in Eden

31.  Boon nights have been arranged for Mungrisdale 12 July; Mosedale 19 July; Hutton Roof 26 July

32.  Village Fun Day Sunday 10 July at 2pm.  There is a Barbecue in the evening and tickets are available

33.  General Correspondence received since the last meeting.

·         CALC newsletters for May and for June/July ~ circulated with Agenda

·         English Nature ~ views on Skidaw Group Site of Special Scientific Interest received

·         Parish Profiles has been received based on 2001 Census ~ will try to add the information to the web site

·         A66 Roadworks ~ Sportsman to Beckces ~ questionnaire was taken by Councillor Bird to complete

34.  Clerk ~ Contract of Employment was unanimously agreed by the councillors and signed by the Chairman.  The clerk has now been in situ for just over a year and it has been an exceptionally busy year and the councillors gave a unanimous vote of confidence in the clerk.

The clerk cannot be self employed and as a result the council must write to the taxman each year to confirm how much has been paid and that this excludes tax.  All councillors agreed.

Next Meeting ~  5th September 2005 in Mungrisdale Village Hall

Matter identified for discussion was The Bridge between the village hall and the Mill Inn.  But it was agreed that the clerk should write to the Environment Agency regarding the base of the bridge being eroded by the river.
