Minutes of meeting of the Parish Council on Monday 10 September 2007 draft

Chairman welcomed councillors and parishioners to the meeting.  Present were Lesley Smith (Chair); Adam Beeston; Alan Bird; Michael Bohling; David Huxley; Ernie Teasdale; Jennifer Stevenson; Les Wilson; Ronnie Wilson and 17 parishioners

1.       Apologies   received from Roy Fisher, Eden District Councillor

2.      Minutes   -  Chairman authorised to sign minutes of the meeting held on 9th July 2007 by unanimous agreement

3.       Public Participation   -   The chairman adjourned the meeting to allow members of the public an opportunity to ask questions or raise matters of interest.  The following were raised:

·         Bob Watt reported that the Fence behind the village hall is now complete

·         Salt Bins ~ Swinside does not have any and with little sunlight the road can be very dangerous.  The County Council will not provide replacements and the council were asked if they could arrange for new salt boxes or piles of salt.

·         Pinfold ~ offers of funding are being received towards the development of a sensory garden and the project is progressing

·         Sign at Low Beckside has appeared for the college.  LDNP have been contacted and it is being investigated.

·         Berrier Hill Windfarm planning application.  Residents from Berrier have formed an Action Group with the majority of residents opposing the application.  Membership of the group is wider than Berrier alone.  A summary of the groups objectives was presented (as per attached note) and the council were asked to object to the application.  An exhibition was held with very little notice before the application was received.  A meeting has been arranged by Greystoke Parish Council on Thursday 13 September.

4.      Declaration of Interest    -   Members were invited to declare any personal interests and any personal interests, which are prejudicial, relating to any item on the agenda and none were declared

5.      Accounts 2007-2008

·      Authorise payment of Bills due by unanimous agreement:

§         United Utilities  £21.82  Garden Ground

§         United Utilities  £16.95  Liscow

·      Income from Car Parking received £260.76

6.      Planning Applications ~ Received

·         7/2007/3099 ~ Provide new 10m pole off DP75 approx 8.2m above ground

·         07/0636  Construction of Wind Farm~ 9 turbines, substation, access track and ancillary development was discussed in public participation and the objections raised to be communicated to the Planning department.~

·         Council to object to the application for the wind farm ~ proposed Ernie Teasdale and seconded Ronnie Wilson and unanimous agreement

7.      Planning Decisions

·         7/2007/3056 Bowscale Cottage ~ replace existing windows to rear  granted with 3 conditions

8.      Berrier Hill Windfarm ~

·         Meeting on 13th September at 7.30 is the Greystoke Parish Council meeting, in Greystoke Village Hall. There will be an opportunity to speak in public participation at the start. 

·         Letter has been received from West Coast Energy offering community trust to parishes of Mungrisdale; Greystoke and Hutton.  Michael Bohling to respond to this on behalf of the council.

9.      Audit 2006-2007 has been approved by the external auditors with no comments.  Notices will go onto the boards.

10.   Tidy Village competition ~ update from David Huxley

·         The whole parish was entered and received a merit award certificate with a score of 80 out of 100.  The voluntary group were thanked for all of their help.  It was suggested that a working group or sub committee be set up reporting to the parish council to continue the ongoing maintenance and to work towards the tidy village next year.  In previous years we have arranged boon nights throughout the parish.  After brief discussion it was decided that David Huxley prepare a proposal for the working group in advance of the next council meeting and to circulate for consideration.  Tidy Village will be added to the November Agenda.

11.    New Code of Conduct ~ Local Authorities (Model Code of Conduct) Order 2007

·         Adopted by the Council ~ proposed Lesley Smith and seconded Michael Bohling and adopted unanimously as follows

§         Mungrisdale Parish Council adopts the model code of conduct contained in the Statutory Instrument No. 1159(2007), as it applies to Parish Councils, with the addition of paragraph 12 (2) as the code of conduct which is expected of members and co-opted members of the authority in the place of the existing code of conduct adopted by the council, with effect from 10 September 2007

·         Training for the code was held at the Town Hall in Penrith on Friday 3rd September and was attended by the Chair and the Clerk. 

·         New registrations of interest were completed by all councillors at the end of the meeting.

·         Notice in the paper to be included in the CALC notification at a cost of £15 to the Council.

12.   CALC road show ~ offer from CALC to attend a meeting of the council as part of the Effective Council Roadshow. Type of issues or typical Agenda to be obtained.

13.   BT Telephone Boxes will be painted and refurbished over the next 12 months. This was confirmed by telephone after the councils letter to BT

14.   Unitary Cumbria Proposals – bid has failed and the two tier system already in place will continue.

15.   CCC – Parish Paths and Volunteer Newsletter July 2007

16.   Garden Waste Skip ~ letter from EDC confirming they would not be providing Garden Waste skips ~ However, Roy Fisher has already acted on our behalf and made alternative arrangements for Garden Skips to continue.

17.   Budget for 2008-2009~ was discussed briefly and a draft will be circulated prior to the November meeting for agreement.

18.   Eden Housing Development Plan ~ consultation ends 21 September

19.   Cumbrian Gypsy and Traveller Accommodation Assessment being completed by EDC.  Details of any Gypsies and Travellers passing through and/or stopping off in the area requested for the review.  Non in Mungrisdale

20.  Dog Fouling has been raised by a Parishioner regarding the track by Bullfell.  The area is common land and it is not possible to put up notices.  The only area a notice could be placed is on a boundary fence.

22.  Clerk Vacancy ~ Number of people interested.  Agreed that 3 councillors should interview and select a candidate.  Unanimously agreed that Lesley Smith Michael Bohling and Ronnie Wilson will interview and recommend to the Council outside of the meeting.
